Senate Joint Resolution Seven Fails (Audio)

The Senate Education Committee killed a joint resolution that prohibits school districts from suing the state. The Committee voted four to three to send Senate Joint Resolution Seven to the 41st legislative day.
The issue came about because a consortium of school districts recently sued the state. Had Senate Joint Resolution Seven passed, voters in the next general election would decide whether or not to amend article eight of the state constitution and make such lawsuits unconstitutional. Senator Ben Nesselhuf of Vermillion opposes the measure. He says it takes away a school's voice.
"This says no school district may be party to any legal proceeding challenging any enactment passed by the legislature," Nesselhuf says. "That is an amazing statement to make, that you will sit and take what we say, and you are not allowed to question us. That's what this does."
Proponents of the joint resolution say it makes no sense for schools to use tax dollars to sue for more tax dollars.
