House Defeats Proposed Clerks of Court Fee Increase

The State House of Representatives defeated a bill that increases a user fee for people who seek records from their local clerk of courts. The amount would change from $15 to $25. Representative Nick Moser says the bill comes at the request of the Unified Judicial System.
"They have a number of processes in place that they've been working on if you recall back they've been working on an overhaul of getting their data automated and online, making it more easily accessible to the people of South Dakota," Moser says. "And I think that this is just part of that process, and it conjunction with some of the budget decisions we made last year, they came and asked for the fee increase."
The bill needed a two-thirds majority to pass. It received 45 yeas and 21 nays and failed. Representative Moser gave an intent to reconsider.
