The State Senate passed Senate Bill 43 which criminalizes caregivers of children who fail to report the death or disappearance of a child within a specified time.
State Senator Angie Buhl of Sioux Falls opposed the bill because she says the proposed legislation does not protect kids.
"I don't believe that it would have any deterrent affect for people who would abuse their children. I think that people who are going to cause harm to their children are going to do it anyway and I think parents are acting in good faith and are already reporting the disappearances and deaths to law enforcement or medical providers as is necessary," Buhl says.
Buhl says the bill is just a reaction to the Casey Anthony Case.
